US ကို ရွှေ့ပြောင်းရောက်ရှိလာတဲ့ မိဘတွေနဲ့အတူ ပါလာပြီး H-1B visa ကိုင်ဆောင်ထားတဲ့ ကလေးတွေအတွက် Green Card လျှောက်ထားခြင်းဆိုင်ရာ စည်းမျဉ်းတွေကို ဩဂုတ်လ ၁၅ က စပြီး တင်းကြပ်လိုက်ပြီ ဖြစ်ပါတယ်၊ ဒီအပြောင်းအလဲဟာ Green Card အတွက် အချိန်ကြာမြင့်စွာ စောင့်ဆိုင်းနေရတဲ့ မိသားစုတွေအပေါ် အကြီးအကျယ် ထိခိုက်စေနိုင်ပါတယ်။
အရင်က ဆိုရင် H-1B visa ကိုင်ဆောင်ထားတဲ့ကလေးတွေဟာ အသက် ၂၁ နှစ်ပြည့်ရင် မိဘရဲ့ ဗီဇာအပေါ်မှီခိုပြီး နေလို့ မရတော့ပါဘူး၊ အသက် ၂၁ ပြည့်သွားရင် Aging out လို့ခေါ်ပြီး သူ့ကို Green Card လျှောက်ထားခွင့်ကနေ ဖယ်ရှားလိုက်တာပါ၊ Green Card လျှောက်ထားတဲ့ လုပ်ငန်းစဉ်က အချိန်ကြာတဲ့အတွက် လျှောက်လွှာစပြီး တင်တဲ့ရက်က ၂၁ မပြည့်သေးရင် ဥပဒေအရ အကာအကွယ်ပေးထားပါတယ်၊ ဆိုလိုတာက Green Card ခွင့်ပြုချက် ပေးတဲ့အချိန်မှာ အသက် ၂၁ ကျော်လွန်နေပေမယ့် စတင်လျှောက်လွှာတင်ခဲ့တဲ့ ရက်က ၂၁ မပြည့်သေးရင် ရပါတယ်။
ခုစည်းမျဉ်းအသစ်မှာတော့ ဒီလိုမျိုး စတင်လျှောက်လွှာတင်ခဲ့တဲ့ရက်ကို ထည့်သွင်း စဉ်းစားမှာ မဟုတ်တော့ဘဲ Green Card ခွင့်ပြုချက် ပေးဖို့ ဆုံးဖြတ်ချက် ချတဲ့အချိန်မှာ ၂၁ နှစ်ပြည့်သွားရင် ပယ်လိုက်မှာ ဖြစ်ပါတယ်၊ ဒီပြောင်းလဲမှုက အမေရိကန်မှာ ကြီးပြင်းလာပြီး Green Card စောင့်ဆိုင်းနေတဲ့ ကလေးငယ်များစွာရဲ့ အနာဂတ်ကို မရေမရာ ဖြစ်စေပါတယ်၊ ဒါ့အပြင် အသက် ၂၁ နှစ်ပြည့်ပြီးရင် အမေရိကားမှာ ဆက်လက်နေထိုင်ဖို့ တခြားနည်းလမ်းတွေ ရှာဖွေရတော့မှာ ဖြစ်ပြီး အခန့်မသင့်ရင် အမေရိကားက နေ ထွက်ခွာရတဲ့အထိ ဖြစ်လာနိင်ပါတယ်။
A new rule for H-1B visa and Green Card applications has come into effect
Starting on August 15, the rules for children of H-1B visa holders applying for Green Cards have become much stricter. This change could significantly impact families who have been waiting a long time for Green Card approval.
Previously, children of H-1B visa holders who turned 21 could no longer be dependent on their parents' visa. This process, known as "aging out," removes them from consideration for a Green Card. However, because the Green Card application process is lengthy, the law protected a child's age based on the date the application was first filed. This meant that even if a child was over 21 when the Green Card was approved, they were still eligible if they were under 21 on the initial filing date.
Under the new regulations, this is no longer the case. The initial filing date will not be taken into consideration. Instead, if a child has turned 21 at the time the Green Card approval decision is made, their application will be denied.
This change puts the future of many children who grew up in the US and are waiting for Green Cards in an uncertain position. Once they turn 21, they will have to find other ways to legally remain in the country, or they may be forced to leave.
