A Warning for Children with H-4 Visas: The Danger of "Aging Out"
US companies hire qualified foreign professionals in specialized fields with H-1B visas. This visa allows them to live and work in the US for up to six years and bring their spouses and children under 21 on H-4 visa.
For children holding an H-4 visa, it's crucial to obtain a green card before they turn 21. Because the green card application process can be very lengthy, the date a person's age is "locked in" because the application is a key factor. Previously, USCIS used the filing date to determine a child's age, but now they only use the date when the green card is issued.
This means that if a child is under 21 when the green card is issued, they can stay on an H-4 visa. However, if they turn 21 before the green card is issued, their H-4 visa becomes invalid.
Due to this new policy from the US Citizenship and Immigration Services (USCIS), children with H-4 visas who won't receive their green card before they turn 21 now need to apply for an F-1 student visa before their current visa expires. This change is part of the new immigration policies that have been implemented under the Trump administration.
