Confusing H-1B Visa Regulations

Last Friday, Donald Trump signed an order to impose a $100,000 fee for H-1B visas. This announcement caused a significant ripple effect, leading companies like Google, Meta, and Microsoft to urge all their H-1B visa-holding employees who are currently overseas on business to return to the U.S. immediately. The new regulation was set to take effect on Saturday morning, making it difficult for employees to return right away.

The $100,000 fee is not an annual payment but a one-time fee to be paid upon submission of the application. While the previous annual fee was only $215, the new amount is a staggering $100,000. The new fee will apply to new applications, but current visa holders may also have to pay it upon renewal. This presents a real challenge for small and startup businesses, except for corporations.

Legal experts say that this order is likely to face legal challenges in U.S. courts. They claim that a president cannot issue such an order without Congressional approval, as Congress is the only authority that sets the parameters for work visas. The only power granted to the executive branch by Congress is to charge fees to recover the cost of processing the application. Even U.S. government officials themselves have been giving conflicting statements on this issue, which has contributed to the ongoing confusion.
